Terms and conditions for raffle

1. The Promoter:

The Irish ME/CFS Association, 12 Beech Park Lawn, Dublin 15 RCN 20100254 CHY 22039

2. No licence has been sought for this raffle as the sales will be kept under €5000 (likely only a fraction of this) https://www.gov.ie/en/press-release/048ef-minister-browne-announces-the-commencement-of-the-gaming-and-lotteries-amendment-act-2019/

By entering this Raffle all entrants agree to be bound by these terms and conditions and any other conditions in the messaging or promotions of this. Any entries not complying with these terms and conditions will not be valid.

3. Ticket prices

€5 per ticket. 5 tickets for €20. To simplify the administration (all activities involved in this raffle are done by volunteers) and due to the fact that most sales will be online, tickets won’t be given to participants. Instead, we will simply note the entries and make out entries for the draw.

 

4. Entry Requirements

4.1. Raffle Period

The Raffle will run from 15th October 2024 to 9th December 2024 (Closing Date) inclusive. All competition entries must be received by the Promoter no later than midnight on the Closing Date. Any tickets received after this date will be disqualified.

4.2. To Enter

People need to get money to the Irish ME/CFS Association to be received on or before December 9, 2024.

There are 2 main ways of doing this:

-         giving the money at the raffle stand at the upcoming 6 Dr David Tuller talks

-         sending the Irish ME/CFS Association money noting it is for the raffle. This can be done by donating using the donate button on the Association’s website marking that it is for the raffle; sending the money to the Irish ME/CFS Association, 12 Beech Park Lawn, Dublin 15 or by bank transfer (we can give out details on request)

 

5. Proceeds from the draw:

The proceeds will be divided approximately 50-50 between the Irish ME/CFS Association’s general and research funds. We likely will not try to break down exactly all the costs associated e.g. the price of envelopes, paper, etc. used so the 50-50 breakdown between the general and research funds will only be approximate. But nobody is paid any commission so 100% of the proceeds will go to the Irish ME/CFS Association.

 

6 Eligibility

- The draw is open to all persons aged 18 or over as at the date of the draw who reside in the Republic of Ireland.

- The Promoter reserves the right to reject any entry (and award the prize to an alternative winner) if it has grounds to believe the entrant has breached any of these terms and conditions, acted fraudulently or illegally, or on other reasonable grounds and shall have no liability to an entrant for any loss or damage arising from such rejection

 

7. The Prizes

7.2. Prize Limitations

The prizes are non-transferable and only consist of what is listed above. No alternative prize will be offered. The prizes are not redeemable for cash. The Promoter accepts no responsibility or liability to winner for any dissatisfaction with the prize.

 

7.3. 7-day requirement to inform us which prize you want

Rather than put the prizes in a particular order, we thought people might refer to be able to select their prize. However for this to work we need people to respond without too much of a delay when offered a prize. So if we do not hear from someone within 7 days (168 hours) of us informing them that they can claim a prize, we reserve the right to move onto the next person. We will still try to accommodate the prizewinner later in the draw if they may contact again.

 

8. Winners selection and exclusion of people running the draw

The draw will take place on December 10, 2024.

Whoever physically runs the draw will be excluded from winning a prize. At this stage it is envisaged that Tom & Vera Kindlon will do the draw so they and their family members are excluded from winning a prize. If someone else needs to step in, the same rules will apply to them (there tickets can be refunded).

 

9 Notification of Winners

The winners will be notified within 5 working days of the closing date either by post, email, text or phone call. The Promoter’s decision is final. The Promoter shall have no liability for the winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for the winner’s provision of incorrect or otherwise non-functioning contact information. If the winner cannot be contacted, is ineligible, fails to claim the prize within 21 days from the time the winner notification is sent, the prize may be forfeited and an alternate winner selected.

It is possible winners may be required to provide proof of identity when collecting their prize though this seems unlikely given the way we are running the draw.

10 Promotion of Winners

By entering this Raffle the winner agrees to take part in reasonable post Raffle publicity by publishing winners’ names on the Irish ME/CFS Association website and possibly elsewhere online.

 

11. Use of Information

The Promoter respects, and is committed to protecting your privacy. The personal information you provide will remain private and will only be used for the purposes of contacting the winners, unless otherwise requested by the individual. The winners’ names will be announced on the website www.irishmecfs.org

 

12. Limitation of Liability

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstance be responsible or liable to compensate the winner or accept any liability (under contract, or otherwise under law) for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees.
